Terms and Conditions

These terms govern access to personal.clinic and the purchase or use of Site5 services from Indigital Technologies LLP.

1. Acceptance

By using this website, accepting a quotation, creating an account or paying for Site5, you agree to these terms, the quotation or order summary, our Privacy Policy, Cancellation Policy, Refund Policy and Digital Delivery Policy. If you do not agree, do not use or purchase the service.

2. Service description

Site5 is an information technology and software service for creating and maintaining professional websites for healthcare professionals and clinics. The exact pages, features, integrations, hosting period, support and delivery target are those stated in the accepted quotation. We may improve or replace non-material technical components while maintaining the agreed purpose of the service.

Site5 does not provide medical advice, diagnosis, treatment, emergency response, pharmacy fulfilment or healthcare services. A customer website is not a substitute for direct consultation with a qualified professional.

3. Customer responsibilities

You must provide complete, accurate and lawfully usable information. This includes professional qualifications, registrations, clinic details, images, service descriptions and contact information. You confirm that you have the rights and consents needed for all submitted content and that it does not infringe third-party rights, mislead patients or breach healthcare advertising requirements.

You are responsible for reviewing and approving content before publication and for promptly notifying us of material changes. You must not misuse the platform, attempt unauthorised access, upload malicious code or use the service for unlawful, deceptive or harmful activity.

4. Orders, fees and taxes

Eligible new customers may purchase the standard first-year Site5 subscription for ₹9. Payments are accepted through app.personal.clinic using Razorpay. Any optional services, taxes and renewal price must be displayed in the application or stated in a written order before payment. Work may begin after receipt of the required information and payment. A failed or overdue payment may result in suspension after reasonable notice.

5. Delivery and availability

Delivery is digital. Timelines begin only after receipt of complete content, approvals and required payment. Internet services can be interrupted by maintenance, hosting providers, security incidents or events outside reasonable control; uninterrupted availability is not guaranteed.

6. Intellectual property

Indigital Technologies LLP and its licensors retain ownership of the Site5 platform, software, templates, code, systems and pre-existing materials. The customer retains ownership of original content supplied by the customer and grants us a limited licence to host, process, display and adapt it solely to deliver and operate the service. Unless separately agreed in writing, purchase of a subscription does not transfer ownership of the underlying software or source code.

7. Third-party services

Hosting, messaging, maps, analytics, payment processing or other integrations may be provided by third parties and can be subject to their own terms and availability. Razorpay acts as a payment facilitator; Site5 remains responsible for its products, support, cancellations and refunds.

8. Suspension and termination

We may suspend or terminate service for material breach, unlawful use, security risk or non-payment, normally after giving an opportunity to remedy the issue where practicable. Customers may cancel according to the Cancellation Policy. Consequences of cancellation, data export and removal are governed by the accepted order and applicable policies.

9. Warranties and limitation

The website and service are provided with reasonable skill and care, subject to the agreed scope. To the maximum extent permitted by law, we do not guarantee specific search rankings, patient enquiries, revenue or business outcomes. Neither party is liable for indirect, incidental or consequential loss except where exclusion is prohibited by law. Nothing in these terms limits rights or liabilities that cannot legally be limited.

10. Indemnity

You agree to be responsible for claims arising from content you supplied, unlawful use of the service or breach of your representations, to the extent permitted by law. We remain responsible for claims caused by our own breach or misconduct as required by applicable law.

11. Governing law and disputes

These terms are governed by the laws of India. The parties will first attempt good-faith resolution through written communication. Subject to applicable consumer rights, courts in Mumbai, Maharashtra will have jurisdiction.

12. Changes and contact

We may update these terms prospectively. Material changes affecting an active paid subscription will be communicated where required. Questions may be sent to support@indigitalit.com.
